At LAYA, we strive to make the process of becoming a neighbor within our communities as simple as possible. In order to assist you in processing your reservation, we’ve created an easy online form that will gather the appropriate information that will be needed to create your Priority Reservation Agreement.

Follow our simple, 4 Step Process:

  1. Make your selection from the available model homes.
  2. Review the Reservation Requirements and Terms.
  3. Supply your Buyer Information.
  4. Click “Reserve My Place.” A LAYA Hotel representative will be in contact with you right away with your completed Reservation Agreement and additional instructions about how to transfer your deposit.

STEP 2: Review the Reservation Requirements and Terms.

Reservation grants the Reservation Holder certain privileges subject to the following terms and conditions:

How To Get Started In Resort Real Estate Overseas Without Putting Any Money Down On The Land And Make No Payments With Zero Interest For 5 Years

  • Buyer will pay a USD $500 Refundable Priority Reservation Deposit to reserve their place and select an available home site.
  • Buyer will pay no down payment on the sale price.
  • Buyer will pay no payments and interest for 5 years from the date of receipt of the Priority Reservation Deposit.
  • Buyer will close with a Public Deed and a mortgage on the “Balance Due”.
  • Buyer will pay the closing costs in the Buyer escrow account upon confirming the Promise of Sale Agreement (Estimate 4% of the sale price).
  • Buyer will pay H.O.A. fees for 5 years in the Buyer escrow account upon confirming the Promise of Sale Agreement (Estimate $.10 ft.2 of the home site).
  • Buyer will pay the municipal property taxes for 5 years in the Buyer escrow account upon confirming the Promise of Sale Agreement (Estimate 1% value of home site).
  • Buyer has the option to walk away after 5 years and not pay the mortgage “Balance Due” without penalty. (Closing Costs, Property Taxes and H.O.A. Fees are non-refundable)
  • Buyer can an assign the Promise of Sale Agreement, Public Deed and the Mortgage Agreement upon approval.
  • Buyer can market and sell the home site and pay the balance owed to PROMISSORY VENDOR and keep the difference.
  • The developer will market and sell the property for the Buyer at a fixed rate of 10% commission of the sale price.
  • If the Buyer keeps the home site, the build time is 5 years after paying the Balance Due on the mortgage.

Limited-Time Bonuses

  • Early Reservation: Receive a 5% Discount off the sale price. (Limited-Time)
  • Multiple Purchases: Receive a 10% Discount off the sale price. (Limited-Time)
  • Quick Pay Option #1: Receive a 15% discount off the sale price if the Balance Due is paid in full to PROMISSORY VENDOR within one year of receipt of the Priority Reservation Deposit. (Some conditions apply)
  • Quick Pay Option #2: Receive a 25% discount off the sale price if the Balance Due is paid in full to PROMISSORY VENDOR within 30 days of receipt of the Priority Reservation Deposit. (Some conditions apply)
  • Trade Up Program: Receive a 100% credit for the unit you purchased to be applied toward a future purchase of any real estate offering at Grupo Mariana. (Some conditions apply)

Use of Funds

  • Buyer funds are held in the buyer escrow account until 100 home sites are sold in the Ambassador Member Offering. (Setup Cost to Buyer)
  • Upon 100 home sites sold, the Buyer funds are transferred from escrow to pay: 1) Contractor to start construction; and 2) Lawyer for closing costs and property taxes.

Timeline

  • The Buyer funds are committed to escrow for one year.
  • If 100 home sites are not sold within one year, the buyer has the option to reclaim the funds from escrow (non-interest-bearing account) with no penalty.
  • The Buyer has the option to extend the Priority Reservation Agreement for an additional year.
  • If 100 home sites are not sold within two years, thePriority Reservation Agreement will be terminated and the Buyer funds in escrow will be returned to the Buyer.
  • Upon the mortgage balance paid in full, the build time on a home site is 5 years.

  • No questions asked, no reason needed – even if you are a few days late with the request, we will understand and return the full amount you paid.

In case the depositor is a foreign LLC or a Company:

  1. A copy of the Articles of Incorporation/Association;
  2. A copy of the Company Bylaws, Company Resolution;
  3. Power(s) of attorney or other documents (s) which grant(s) legal authority to the authorized signatory to act as the legal representative for the entity for the matters related to this Reservation Agreement and to sign on behalf of the entity; and
  4. A copy of passport and driver’s license issued by a Governmental entity (legible and in force) of legal representatives.

In case the Depositor is a Trust:

  1. A copy of trust agreement and its modifications if any; and
  2. A copy of driver’s license and passport issued by a Governmental entity (legible and in force), of the person authorized to act on behalf of said trust as well as of the Beneficiary.

Subject to the adjustments described herein, the Sale Price will be payable by the PROMISSORY PURCHASER as follows:

The PROMISSORY PURCHASER will pay a “Priority Reservation Deposit” of FIVE HUNDRED UNITED STATES DOLLARS (USD $500.00).

The Priority Reservation Agreement deposit will be refundable for a period of thirty days (30), in which the PROMISSORY PURCHASER may cancel unilaterally this Reservation Agreement by written communication to the PROMISSORY VENDOR.

Return of Reservation Agreement Deposit

The PROMISSORY PURCHASER may at any time request the PROMISSORY VENDOR to return the Reservation Deposit within 30 days (30) of the receipt of the Priority Reservation Deposit, and upon receipt of such written request, the promissory VENDOR shall forthwith deliver to the PROMISSORY PURCHASER the Reservation Agreement deposit within three business days via PayPal.

Payment Terms

Subject to the adjustments described herein, the sale price will be payable by the PROMISSORY PURCHASER as follows:

The PROMISSORY PURCHASER will pay a refundable “Confirmation Deposit” of FIVE THOUSAND UNITED STATES DOLLARS (USD $5,000.00) to the Buyer escrow account within (30) thirty days from the date of the receipt of the Priority Reservation Agreement Deposit. (Some conditions apply)

Balance Due

The PROMISSORY PURCHASER will pay the refundable “Balance Due” to the Buyer escrow account within (90) ninety days from the date of receipt of the Priority Reservation Agreement Deposit. (Some conditions apply)

All cost of fees associated with the execution of the Promise of Sale will be paid by the PROMISSORY PURCHASER on or before the date title is transferred with the issuance of the Public Deed of Sale. Currently, the estimated closing costs are:

  1. Estimated 1% of the purchase price for Central Government transfer tax;
  2. Estimated 1% of the purchase price as the municipal tax;
  3. Estimated 1% of the purchase price for the Public Registry Duties per lot/unit; and
  4. Estimated 1% of the purchase price for attorney fees.

The attorney of record prior to the closing date will send a Closing Cost statement and any additional amount required by law or that corresponds to additional services requested by the PROMISSORY PURCHASER.

The PROMISSORY PURCHASER recognizes that without the deposit of this amount, the Public Deed of Sale may not be issued until this condition is verified.

The PROMISSORY PURCHASER recognizes these are estimates according to current regulation and recognizes definitive amounts to be covered can only be determined at the time the Closing Cost statement is sent.

Upon acceptance of the Reservation Agreement by the PROMISSORY VENDOR, a Promise of Sale Agreement will be provided to the PROMISSORY PURCHASER with all terms of the sale and is to be signed by the PROMISSORY PURCHASER and PROMISSORY VENDOR within (7) seven days.

Failure by the PROMISSORY PURCHASER to comply with the General Terms and or payment of the Reservation, Confirmation Deposit and balance due, all terms and conditions set forth in the Reservation Agreement will be voided unless otherwise agreed in writing between the PROMISSORY PURCHASER and the PROMISSORY VENDOR.

* The Sale Price is net of any withholding tax or any other deduction that might be applicable.

* All amounts are in United States Dollars unless otherwise specified.

The Reservation Agreement may not be accepted if:

* An accepted Reservation Agreement is already in place on the Unit(s) described above;

* A Reservation Agreement is in progress on the Unit(s) described above or;

* Any portion of this Reservation Agreement is not complete (including your written signatures(s); and

* The PROMISSORY VENDOR rejects Reservation Agreement for any reason.

Grupo Mariana, S.A. will not disclose to third parties any information regarding the PROMISSORY PURCHASER without previous written consent, except as required to open an escrow account.
